My Chinese parents have just been denied a US tourist visa in Toronto. I am recovering from cancer surgery. I would really like to see my parents!

Furthermore, I AM ALSO US CITIZEN and a ChineseAmerican. Because of this, my parents qualify for a greencard, meaning my parents have a RIGHT TO IMMIGRATE to the USA and live here(US law), so WHY CAN'T THEY VISIT now?(They visited before and returned to China!).

All are hiding behind THE ANTIQUE LAW 214(b) that basically states that a Chinese has to prove IN ADVANCE that they will not brake US law once here and "overstay". How can one do THAT? Thus most get denied.

"According to Section 214(b), applicants for nonimmigrant visas are presumed to be intending immigrants. In order to overcome this presumption, applicants must prove the existence of strong ties to their own country that are sufficient to compel their return after a short stay. A consular officer's determination of whether an applicant qualifies for a nonimmigrant visa must be made on the basis of the objective circumstances presented by the applicant, and what these circumstances indicate about the applicant's intentions, particularly when considered in the socio-economic context of the applicant's home country. In addition, the applicant must provide evidence supporting the stated purpose of travel to the United States ."

This law was created for NON-IMMIGRANT visa applicants (students,tourists), so they don't come and stay forever. It was NOT ment to be applied for people who HAVE A RIGHT to immigrate, but just want to visit!!! (this is really a different category, right?!) Thus is law does not apply to them! And should be granted a tourist visa!

As per US-law, parents, under-age kids and spouse of a US-citizen have a right to IMMIGRATE immidiately without waiting period and without any nummeric limitation. Thus, if they just want to visit, they should be allowed to do that. Not everybody wants to immigrate to this screwed up country.

So a little change by congress in the 214(b) law could say: " This law does not apply to persons who have a right to immigrate and have no nummeric limitation" (Like some visa). This would fix the problem for many parents, spouses and kids, who just want to visit but not to live here!

CONGRESS PERSONS say they can not change this? Last time I checked, THEY make the laws. If they can't change things WHAT are we supposed to do? Start a revolution every 200 years? If they don't want to change things, then they are useless in DC and we got to have more TEA Parties.

We do however have a little joke for the Chinese and other applicabts. We charge $150/visa application, and as per Beijing US Embassy, we deny 500,000 such application per year and make a cool $50,000,000 ($50 million) from them. Nice way to build international relations...

I am all for it charging an administrative fee for successful applicants, but we should refund the fee if the visa is denied.

If I or wallstreet do that, it would be called fraudulent advertisement. And the consulate tells every rejected applicant that they can apply again and waste another $150, to get denied again. Perhaps a smart lawyer files a class action suit against the state department and gets all that money back.

And the Congress-people of Washington? If they respond, the best they can do is send a letter of support! Big Deal. I bet they did more for the $5billion they got from AIG and Wallstreet!

Just like with education, healthcare and the legal system, Europe seems to be smarter again: If you invite a foreigner, you have to post a bond and health insurance, and it works! Many Chinese and others visit Europe and it's good business. Are we really that stupid that we can't do that same?

So WHY did we vote in a Democratic Congress? So they do nothing? Can we expect that from the Obama? BEWARE of politicians who promise you things! THEY LIE! Let's throw these rascals out next election!
